Ways to Establish Proof of Manufacturer (POM)

  • The Claimant Information Guide (CIG) is a tool intended to summarize the information in the Plan Documents. For questions about ways to establish acceptable POM refer to section 5 of the CIG.
  • An affirmative statement is a letter from a physician attesting that the claimant was implanted with Dow Corning implants. For an affirmative statement to be acceptable, it must contain the reason for that conclusion. Affirmative statements may not be used if they contradict a statement previously submitted by the same physician. The Affirmative Statement List provides the current list of physicians that the Settlement Facility may accept an affirmative statement from. For more information on affirmative statements, refer to The Settlement Facility and Fund Distribution Agreement (Annex A), Schedule I, Part I, (B) (5).
  • The Stipulation and Agreed Order Regarding PRE-1971 Breast Implant Identification Protocol signed July 29, 2005 is an additional resourcee for claimants who received their breast implants prior to 1971.
